Public Event Terms & Conditions

1. Pricing & VAT

• All prices advertised to the public are inclusive of VAT (if applicable).

• Trott & Whinny Ltd reserves the right to amend retail prices if VAT rates or supplier costs increase prior to or during the event.

2. Pitch Fees, Minimum Spend & Trading Costs

• Any pitch fees, site hire charges, or trading licence costs must be agreed in advance of the event.

• Where pitch fees are payable by Trott & Whinny Ltd, these must be invoiced by the Event Organiser and paid under the agreed terms.

• Where fees are payable by the Event Organiser, written confirmation must be provided prior to the event.

• Where an agreed minimum spend has been stipulated:

  • If sales fall short of the minimum spend, the remaining balance must be settled in full before Trott & Whinny Ltd leave the premises.

  • If this balance is paid by card rather than bank transfer, card processing fees will be added to the total due.

3. Event Conditions & Trading Hours

• Trott & Whinny Ltd will trade during the hours specified by the Event Organiser.

• If an event closes early or public attendance is significantly lower than advertised:

  • Trott & Whinny Ltd accepts no liability for loss of sales.

  • Refunds of pitch fees due to poor attendance, adverse weather, or early closures are at the discretion of the Event Organiser and must be agreed in advance.

4. Power, Water & Waste

• Access to a safe and reliable 240v electricity supply (Mains, 16Amp or 32Amp) must be provided unless otherwise agreed in writing.

• If adequate power is not supplied as agreed and trading cannot continue safely, Trott & Whinny Ltd reserves the right to withdraw without penalty.

• Adequate waste disposal facilities must be provided by the Event Organiser for all traders.

5. Venue Access & Safety

• The Event Organiser must ensure ample, level, and safe access for our catering trailers, including:

  • Sufficient space for set-up.

  • Safe working conditions.

  • Compliance with health and safety standards.

• Trott & Whinny Ltd reserves the right to refuse service if our team or trailers are put at risk due to:

  • Improper location or restricted access.

  • Insufficient space to set up and trade safely.

  • Unsafe camber, ground conditions, or hazards that compromise staff safety or trailer stability.

• If service cannot proceed due to unsafe venue conditions:

  • Any pitch fees or costs already paid by Trott & Whinny Ltd remain non-refundable.

  • Any minimum spend guarantee remains enforceable.

6. Liability & Responsibility

• Trott & Whinny Ltd maintains full public liability insurance for trading at public events.

• Responsibility for the following remains with the Event Organiser, not Trott & Whinny Ltd:

  • Event security.

  • Public safety management.

  • Crowd control.

• Trott & Whinny Ltd accepts no liability for losses arising from:

  • Inadequate event organisation.

  • Insufficient facilities.

  • Failure of third-party suppliers.

7. Food Safety & Allergies

• All food is prepared in compliance with UK food safety legislation and in accordance with our 5-star hygiene rating.

• Food not consumed within two hours at room temperature must be disposed of. Trott & Whinny Ltd accepts no responsibility for food consumed after this period or away from the event venue.

• Food Allergies & Intolerances:

  • Allergen information will be clearly displayed at point of sale.

  • While every precaution is taken to avoid cross-contamination, all food may contain traces of allergens.

  • Customers with severe allergies are advised to speak with our staff before ordering.

8. Force Majeure

• Trott & Whinny Ltd cannot be held responsible for cancellation, reduced trading hours, or loss of sales caused by:

  • Adverse weather conditions.

  • Safety concerns raised by the Event Organiser or authorities.

  • Acts of God, strikes, or circumstances beyond our reasonable control.

• Standard cancellation terms will apply in these situations.

9. General Terms

• Confirmed bookings with Trott & Whinny Ltd are binding once accepted in writing by both parties.

• Trott & Whinny Ltd reserves the right to withdraw from an event if:

  • Conditions are unsafe.

  • Facilities are inadequate.

  • Agreements are breached by the Event Organiser.

• These Terms & Conditions are governed by the laws of England and Wales, and both parties submit to the jurisdiction of the courts of England and Wales.
